Indore-based Pioneer Compu­ters opened a 3,500 sq ft retail IT outlet with the name eMall. Apparently, this is the same name used by another channel partner based in Ahmedabad- Sai Info Systems. Both the companies claim to have registered the name 'eMall' as their trademark.

Sai Info Systems opened an 8,000 sqft retail outlet for IT products recently using the name-eMall in Ahmedabad. According to Vijay Mandora, Executive Director, Sai InfoSystem, the formalities to register the name as a trademark was done long back. “At the time of registering the name we did not come across any other company using eMall as a registered name. If someone else is using this name the only thing we can would do is try and convince them to use some other name. And if that is not working, we will have to look at other practical ways to reach a fair conclusion,” said Mandora.

According to SIS, it first formed a company called eMall Infotech Pvt Ltd to open a series of retail outlets under the trademark eMall. “So in a way we also have the word eMall in our company name that was registered prior to opening the retail outlet. We conceptualized the project about one-and-half years back, before coming up with the first outlet with this name. We plan to have a chain of 15 such malls across the country,” he said.

Meanwhile, Rakesh Agarwal of Pioneer Computers also claimed to have applied for trademark registration of the name eMall many months ago. “When we applied for registration, the name eMall was not in use,” said Agarwal. “If this name is being used by any other company, we will look in to the details of this registration and see what best can be done,” Agarwal added.
